The current U.S. regulatory picture
The FTC adopted an amended Negative Option Rule in 2024 that included a widely discussed “click-to-cancel” requirement. A federal appeals court vacated that amended rule in July 2025. In 2026, the FTC opened a new public process concerning negative-option practices.
That does not mean subscription cancellation is unregulated. Federal statutes, state automatic-renewal laws, sector-specific rules and general consumer-protection requirements may still apply. Requirements vary by business model and jurisdiction.
